Wills, Trusts & Probate

If someone passes away without a trust, their estate typically goes through probate. With a will in place, the person is said to have passed "testate," meaning they can specify their heirs, and their assets are distributed according to their wishes. Without a will, they pass away "intestate," and their assets are distributed to "heirs at law," as outlined by the Probate Code. While probate administration is similar to trust administration, it is conducted under the oversight of the probate court.


Sharmane Estolano or Brett Perkins can be named the executor of your estate in your will. If the chosen executor(s) are unable or unwilling to fulfill their duties, Sharmane or Brett can be nominated as the Administrator or Personal Representative of the estate. In cases where litigation arises, they can also act as a neutral Administrator, safeguarding assets and ensuring a smooth and efficient completion of the administration process.

  • Develop and implement investment strategy with qualified and credentialed financial advisors to align with estate settlement timelines and objectives.
  • Coordinate such advisors on investment decisions.
  • Oversee financial investments during administration with the guidance of financial advisors.
  • Manage capital changes, corporate reorganizations, and other relevant matters.
  • Administer the estate impartially according to governing documents and state law.
  • Coordinate and file final personal income and trust fiduciary tax returns.
  • Prepare and file estate and gift tax returns.
  • Oversee medical care, insurance claims, and reimbursements for trust beneficiaries.
  • Maintain records of estate administration and lease negotiations.
  • Manage real estate maintenance, repairs, and improvements.
  • Evaluate the need for leverage on real estate assets and ensure compliance with loan covenants.
  • Facilitate real estate transactions and 1031 tax-deferred exchanges.
  • Collect rental income and manage related expenses.
  • Procure, hire, and manage qualified and credentialed professionals to oversee non-financial assets. (i.e  oil, gas, mineral interests, closely held businesses, private equity, and intellectual property)
